If you do not live in Illinois, this case probably does not affect you at all.
If, on the other hand, you do live in Illinois, and since March, 2015, you either have, or may apply for a FOID card, this case affects you in that it will determine whether or not the Illinois State Police Firearms Services Bureau can charge you more than the $10.00 allowed by law to apply for, change an address for, or renew a FOID card in Illinois.
If you have received an e-mail, letter or other notice indicating that you are a member of a class action related to overcharging for FOID cards, this case most likely affects your rights.
Since March, 2015, in violation of Illinois statute, the Illinois State Police, Firearms Services Bureau, has been charging $11.00 for a FOID card, when the statute expressly limits the charge to $10.00. The Firearms Services Bureau admits that there is no mechanism to apply for a FOID card and pay only $10.00. If the Plaintiff is successful, we will put a stop to this overcharge and force the Defendant to disgorge the overpayment.
This page will be updated as the situation progresses.
